{"id":122,"date":"2016-03-04T19:16:04","date_gmt":"2016-03-04T19:16:04","guid":{"rendered":"http:\/\/www.roecpa.com\/blog\/?p=122"},"modified":"2016-03-04T19:46:25","modified_gmt":"2016-03-04T19:46:25","slug":"irs-going-after-golf-courses-for-tax-deduction","status":"publish","type":"post","link":"https:\/\/www.roecpa.com\/blog\/irs-going-after-golf-courses-for-tax-deduction\/","title":{"rendered":"IRS Going After Golf Courses for Tax Deduction"},"content":{"rendered":"<p><a href=\"http:\/\/www.roecpa.com\/blog\/wp-content\/uploads\/2016\/03\/Golf-Course-Easement3.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-123\" src=\"http:\/\/www.roecpa.com\/blog\/wp-content\/uploads\/2016\/03\/Golf-Course-Easement3-300x270.png\" alt=\"Golf Course Easement3\" width=\"300\" height=\"270\" srcset=\"https:\/\/www.roecpa.com\/blog\/wp-content\/uploads\/2016\/03\/Golf-Course-Easement3-300x270.png 300w, https:\/\/www.roecpa.com\/blog\/wp-content\/uploads\/2016\/03\/Golf-Course-Easement3.png 314w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a>It\u2019s getting much tougher to successfully claim a charitable deduction for a conservation easement.\u00a0 Unfortunately, this will further erode the construction of new golf course projects in 2016 and beyond.<\/p>\n<p>Typically, a new golf course project will make consideration plans to conserve and protect the natural habitat of fish, wildlife, and natural ecosystem by preserving open space for the scenic enjoyment of the general public.\u00a0 \u00a0These easements often amount to sizeable charitable deductions which help offset the investment.<\/p>\n<p>Although the IRS has lost several conservation easement cases regarding golf courses, they turned the tide in 2003 and 2005 and have become more aggressive fighting these situations.\u00a0 In 2003 and 2005, the IRS went to Tax Court over two North Carolina <a title=\"Golf Course Tax Easements - IRS Tax Audits\" href=\"http:\/\/alliantnationalblog.com\/court-action-golf-courses\/\" target=\"_blank\">golf course easements<\/a>.\u00a0 In both instances, the IRS disagreed with the taxpayers over charitable deductions.\u00a0 \u00a0The court, the IRS stated that \u201cfairways, tee boxes and greens \u2026 are sodded or planted with 419 Bermuda and Tidwarf, which are <a href=\"http:\/\/www.roecpa.com\/blog\/wp-content\/uploads\/2016\/03\/Golf-Course-Easement2.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium wp-image-124\" src=\"http:\/\/www.roecpa.com\/blog\/wp-content\/uploads\/2016\/03\/Golf-Course-Easement2-208x300.png\" alt=\"Golf Course Easement2\" width=\"208\" height=\"300\" srcset=\"https:\/\/www.roecpa.com\/blog\/wp-content\/uploads\/2016\/03\/Golf-Course-Easement2-208x300.png 208w, https:\/\/www.roecpa.com\/blog\/wp-content\/uploads\/2016\/03\/Golf-Course-Easement2.png 243w\" sizes=\"auto, (max-width: 208px) 100vw, 208px\" \/><\/a>nonnative grasses and consequently do not provide a relatively natural habitat for the pitcher plants and Venus flytraps.\u201d\u00a0\u00a0Additionally, the court found that the use of pesticides, insecticides, fungicides, herbicides and fertilizers not only does not preserve the natural habitat, but actually \u201cinjures or destroys\u201d the habitat.\u00a0And, being part of a gated community that is not open to the general public does not provide scenic enjoyment for the general public.\u00a0 In both cases, the IRS won.<\/p>\n<p>In 2009, a coastal Alabama golf course project, <a title=\"IRS Battles over Tax Easements -
